Terms of Services
This Customer Agreement (“Agreement”) sets forth the terms and conditions governing your Account at FLEXYTRADE (“Company”, “us”, “we”, “Site” or “FlexyTrade” or other similar terms) and all Contracts and other transactions in this Account with FlexyTrade. In this Agreement, the undersigned customer is referred to as “Customer” or “You”.
- Agreement to Use FlexyTrade Services
1.1. You have received, read, and understood this Agreement, and the contents of this Agreement are in a language you understand. By signing below and/or using the FlexyTrade Website, you agree to be bound by this Agreement and any other agreement that may be indicated on the FlexyTrade Website from time to time.
1.2. You have the legal capacity to enter into this Agreement.
1.3. You warrant that all information or documents you provide or will provide are true and correct and are genuine and authentic.
1.4. You will be solely responsible for the confidentiality, protection, and use of the password and/or trading PIN that provides electronic access to your Account. Any orders or instructions received under your Account are authorized by and binding on you.
1.5. You agree to conduct business with FlexyTrade by electronic means. You have and know how to use a computer with Internet access, an e-mail address, and services for online access to your Account, and to download, save, or print electronic records. You are obliged to maintain your computer and online services to properly use your Account.
1.6. Your use of electronic signatures to sign FlexyTrade documents legally binds you in the same manner as if you had manually signed. If you sign electronically, you represent that you have the ability to access and retain a record of the documents. You are obliged to periodically review the Website for changes or modifications to said documents and for important announcements.
1.7. You agree to comply with all laws, rules, and regulations promulgated by governing and regulatory institutions, including FlexyTrade company policies applicable to your Account.
1.8. You agree to pay FlexyTrade a fee consistent with your selected service package, effective from the date you purchase on the Website, and hereby authorize, for this purpose, the debit and processing of your credit card and/or other payment methods.
1.9. You acknowledge that you are responsible for the payment of applicable taxes on any gains derived from the use of the Website’s services.
1.10. You understand and agree that FlexyTrade will, at its own discretion, review your Account from time to time to check compliance with laws, regulations, and policies, and that you will immediately rectify any irregularities or deficiencies on your Account upon notice given to you in writing.
1.11. You understand that FlexyTrade provides tutorial/informational materials found on the Website that are considered useful for your trading. You understand that you are responsible for using these materials and/or attending these seminars for your benefit.
1.12. You may terminate your trading Account by canceling your service package in accordance with the process on the Website. Such termination will not affect your obligation to pay any fee/balance or any right that FlexyTrade may have that arose prior thereto.
- Disclaimer of Warranties and Limitation of Liability
2.1. You expressly agree that your use of the Site and any publications, presentations, financial trading information, pricing data, trade data, performance information, blogs, postings or other information, content, services and materials contained in, accessed via, or described on the Site are at your own risk.
2.2. That all such information, content, services and materials are provided on an “As is” and “As available” basis. To the full extent permissible by applicable law, FlexyTrade makes no and hereby disclaims all representation or warranties of any kind, expressed or implied, as to the availability, operation and use of the Site or the information, content, materials or services on or accessed via the Site, including but not limited to warranties of merchantability, fitness for a particular purpose, title, noninfringement and implied warranties arising from a course of dealing or course of performance.
2.3. In addition, FlexyTrade does not represent or warrant that the information accessible via the Site is accurate, complete, reliable or current and is not responsible for any errors or omissions therein or any adverse consequences resulting from your reliance on any aspect of the Site. Further, FlexyTrade makes no representations and warranties that the Site will be uninterrupted, secure, or free of errors, viruses, or other harmful components. In no event shall FlexyTrade or its affiliates, or the directors, officers, employees, agents or representatives of FlexyTrade be liable to You or any third party for damages of any kind arising out of the use of, access to, reliance on, inability to use or improper use of the Site, any information posted on the Site by its users, or any other information, content, materials or services available on the Site (including, but not limited to, any direct, indirect, special, punitive, incidental or consequential damages or damages for loss of profits, goodwill or revenue, business interruption, or loss of data), even if advised of the possibility of such damages, and regardless of the form of action, whether in contract, tort, or otherwise. Specific state laws do not permit limitations on implied warranties or the exclusion or limitation of certain types of damages; thus, some or all of the disclaimers, exclusions, or limitations above may not apply to you.
- Billing, Payment, and Withdrawals
3.1. You agree to pay a service fee concomitant with your selected evaluation pack, effective on the date of purchase for an account. This initial fee is non-refundable, even if you subsequently cancel your subscription. Said service fee will recur on a periodic basis according to your selected payment plan. For this purpose, you authorize FlexyTrade to process and debit your credit card or any other payment method allowed on the Website.
3.2. You understand that your request for cash/shares out of your Account will be subject to review and approval by FlexyTrade. Upon approval, the amount of the request shall be withdrawn using the available channels on the Website. All payout requests will be irreversible upon confirmation by FlexyTrade.
- Communications
4.1. All communications, whether by telephone, messenger, mail, electronic means, or via the FlexyTrade Website or any other means, sent to you at the address indicated in this Agreement, any other information sheet, or at such other addresses as you may hereafter give FlexyTrade in writing and/or electronically, will constitute personal delivery to you, whether received or not. In the event of your failure to notify FlexyTrade in writing of any change of address, all communications will be directed to the last known address appearing in its records. The contents of all communications sent to your indicated address will be conclusive and binding on you in the absence of a written objection received by FlexyTrade within twenty-four (24) hours from the time the communication was sent to your address.
4.2. You understand that all your communications to FlexyTrade should be sent to and from the e-mail address at support@flexytrade.com.
- Miscellaneous
5.1. If any provision of this Agreement is held to be illegal, invalid, or unenforceable under present or future laws, such provision will be fully severable, and the remainder of this Agreement will still be in full force and effect.
5.2. All the terms hereof will be binding upon your heirs, executors, administrators, personal representatives, and assigns.
5.3. In case of your death, FlexyTrade will not be obligated to act upon any orders or instructions from your heirs until the latter have submitted all documents required by FlexyTrade to establish their claim.
5.4. This Agreement, any attachments thereto, and any other agreement on the Website necessary to give effect to this Agreement, contain the entire Agreement between FLEXYTRADE and you.
5.5. You will not assign this Agreement or any rights and obligations under this Agreement without first obtaining the prior written consent of FlexyTrade. FlexyTrade may assign, sell, or transfer its rights under this Agreement, or any portion thereof, at any time, without your consent.
5.6. FlexyTrade reserves the right to amend this Agreement without prior written notice to you. The current version of the Agreement will be posted on the FlexyTrade Website, and your continued account activity after such amendment constitutes your Agreement to be bound by all amendments to this Agreement, regardless of whether you have actually reviewed them.
5.7. FlexyTrade may, at its sole discretion, terminate this Agreement or close, deactivate, or block access to your Account for cause.
5.8. FlexyTrade may discontinue its online services, either temporarily or permanently, without prior notice to you, in order to carry out system repairs, maintenance, upgrades, or to protect FlexyTrade or its clients from losses.
5.9. The failure of FlexyTrade to insist upon strict performance of any of the terms and conditions of this Agreement will not be deemed a relinquishment or waiver of any right or remedy that FlexyTrade may have. No waiver by FlexyTrade of any right under this Agreement will be deemed to have been made unless expressed in writing and signed by FlexyTrade.
5.10. You should also agree to observe proper Internet etiquette when using social media. All correspondences in these sites are considered public. All communications therein will not be considered filtered or screened by FlexyTrade, which reserves the right to undertake legal action against any individual or entity who shall abuse these sites to the detriment of FlexyTrade.

By using the Site and accessing the services offered through the Site (the "Services"), you agree to be bound by all the terms and conditions outlined in these Terms of Use (the "TOU") concerning your use of the Site and the Services.You also acknowledge that you are the sole authorized user of your Account and that it is your responsibility to safeguard your User ID and Password.
Internet Usage and Security
You understand and accept that FlexyTrade cannot be held responsible for the availability or security of your Internet service provider (ISP). FlexyTrade is not liable for any connectivity issues arising from ISP-related problems or security breaches originating from your ISP.
Use of Third-Party Websites
For your convenience, FlexyTrade provides links to other websites containing information or materials that may be relevant to your online trading needs. Please note that this does not constitute an endorsement by FlexyTrade. The contents of these websites and the opinions expressed therein are not under the control of FlexyTrade.
Other Media and Modes of Communication
FlexyTrade's services extend beyond the FlexyTrade website and may include software and applications for use on various electronic devices. These services are also available on other social networking platforms, collectively referred to as "Social Media".
We value your feedback on our policies, network systems, and other products and services.
However, we expect that you will not engage in the following:
• Abuse, threaten, harass, defame, stalk, or violate the legal rights of FlexyTrade administrators, as well as other FlexyTrade members and clients.
• Publish, post, distribute, or disseminate material or information that may be defamatory, infringing, obscene, indecent, or unlawful.
• Upload or attach files that are not under your direct control or for which you have no legal rights in compliance with Intellectual Property laws.
• Upload or attach files that may contain viruses, corrupted files, or other software or programs that can harm another person's computer.
• Delete author attributions, legal notices, or proprietary designations or labels from any uploaded files.
• Misrepresent or alter the origin or source of any material, software, or file that is uploaded.
